‘Charitable Immunity’ Bars South Carolina Diocese Sex Abuse Case

A since-abolished “charitable immunity” doctrine still shields a South Carolina diocese from allegations of sexual abuse by one of its priests during the early 1960s, a federal appeals court affirmed in an unpublished opinion on Wednesday.

A woman, using the pseudonym Mary Roe, sued the Diocese of Charleston in 2021 over alleged abuse she says transpired between 1961 and 1966. A US district judge granted summary judgment to the diocese based on that doctrine which was in place during that time period.
