ChapStick Consumer Gets Class Certified in Natural Labeling Suit

A federal judge certified a consumer class in a suit brought by a woman who says GlaxoSmithKline Consumer Healthcare Holdings (US) LLC and Pfizer Inc. falsely label ChapStick products with claims about naturally sourced ingredients.

The US District Court for the Northern District of California on Tuesday certified the class under Rule 23(b)(2), but denied certification under Rule 23(b)(3) due to a deficiency in the plaintiff’s proposed damages model.
