A pet owner’s testimony that the phrase “biologically appropriate” on a Champion Petfoods dog food label was misleading because the product contained BPA isn’t enough to sustain a consumer protection claim under Wisconsin law, the Seventh Circuit said.
Scott Weaver’s testimony that he thinks any level of BPA renders the food not biologically appropriate doesn’t show that a reasonable consumer would think the phrase means BPA-free, the U.S. Court of Appeals for the Seventh Circuit said on Wednesday.
