Chamber Again Opposes ERISA Class Covering Thousands of Plans

The US Chamber of Commerce called on the Fifth Circuit to reject a class action covering thousands of benefit plans serviced by Fringe Benefit Group, arguing that the reasonableness of thousands of contracts can’t be resolved in a single proceeding.

Multi-plan ERISA classes fail on standing grounds because they involve participants in one plan challenging the management of other plans they have no connection to, the Chamber argued in an amicus brief filed Tuesday.
