Challenge to Washington Covid-19 Misinformation Inquiry Fails

A group of doctors and a former NBA star failed to revive their challenge at the Ninth Circuit to the Washington Medical Commission’s investigation into their alleged spreading of Covid-19 misinformation, since the physicians are already challenging the state’s investigation in state court.

Court of Appeals for the Ninth Circuit Judge Milan D. Smith’s majority opinion said the lawsuit is barred by a judicial doctrine known as Younger, which says that federal courts must abstain from intervening in ongoing state proceedings.
