Challenge to Transgender Athlete Ban in West Virginia Proceeds

An 11-year-old transgender girl may proceed with a suit seeking to topple West Virginia’s new law barring transgender girls from participating in school sports consistent with their gender identity, the Southern District of West Virginia ruled.

The plaintiff, identified as B.P.J., sufficiently alleges that the law violates her right to equal protection by discriminating against her on the basis of sex, the U.S. District Court for the Southern District of West Virginia ruled Wednesday.
