A Minnesota man required to register as a predatory offender waited too long to bring a civil rights claim alleging the ongoing registration requirements violate his constitutional rights, the state high court said.
Bryan Franklin waited more than 10 years to file his challenge, making it untimely under the state’s six-year statute of limitations, the Minnesota Supreme Court ruled in an opinion by Justice Gordon Moore.
The court rejected Franklin’s argument that the registration requirements are a “continuing violation” that tolls statute of limitations.
