Casino Buffet Workers Revive Mass-Layoff Notice Suit on Appeal

Workers laid off from a buffet attached to a Genting New York LLC casino can try again to show that they didn’t receive proper notice before they lost their jobs.

A reasonable factfinder could have determined that the buffet functioned as a protected operating unit under the Worker Adjustment and Retraining Notification Act, so “neither side is entitled to summary judgment,” the US Court of Appeals for the Second Circuit said Monday.
