Block Inc., the parent company of mobile payment service Cash App, failed to convince a federal judge to toss a proposed class action alleging its role in sending out referral text messages violated Washington’s anti-spam statute.
Block’s counsel’s attempt to recycle arguments that failed to secure dismissal in a similar case against Robinhood LLC, an investment app, fell short once again because of Block’s role in creating the app and referral program promoted in the challenged communication, as well as in drafting the sample message, the US District Court for the Western District of Washington said Thursday.
