Carrington Mortgage, Alvaria Beat Suit Over 2023 Data Breach

Nationwide mortgage lender Carrington Mortgage Services LLC and its call-center contractor Alvaria Inc. defeated for now a proposed class action alleging they failed to protect the personal information of Carrington customers that was exposed in a March 2023 data breach.

The plaintiffs failed to establish that they suffered concrete injuries sufficient for standing to sue in federal court, Judge Allison D. Burroughs of the US District Court for the District of Massachusetts said Sept. 20.

Burroughs granted the defendants’ motion to dismiss, but gave the plaintiffs leave to file an amended complaint.
