A Pennsylvania company must face a lawsuit from a fired employee who alleges the termination stemmed from disclosing his past opiate use and recovery process.
Jeremy Spak plausibly alleged The Oscar Smith Co. discriminated and retaliated against him in violation of the Americans with Disabilities Act and Pennsylvania’s Human Relations Act, Judge Julia K. Munley said. Spak also sufficiently pleaded that the company’s owner, Clifford Muench, aided and abetted the alleged state law violation.
Spak has “alleged sufficient facts to establish an adverse employment action and a causal connection between his protected activity and that adverse action,” Munley said Wednesday ...
