Carfax Inc. failed to convince a federal court to dismiss a proposed class action alleging it sold the personal information of drivers collected from state motor-vehicle departments and local police departments in violation of the Driver’s Privacy Protection Act.
Lead plaintiff Benjamin Lucas plausibly alleged that Carfax obtained and sold his DPPA-protected information for an impermissible purpose as defined under the statute, Judge Julie R. Rubin of the US District Court for the District of Maryland said Monday.
Rubin denied Carfax’s motion to dismiss, but said the company could reassert its legal challenges on a full record at summary judgment. ...
