Car Dealership Faces State Justices Over Arbitration Agreement

California Supreme Court justices considered Tuesday whether a car dealership’s hard-to-read arbitration agreement rises to the level of being unconscionable and unenforceable.

The state high court pressed both the dealership and its former employee to narrow their arguments and avoid any pitfalls that would fly in the face of state and federal law or legal precedent.

Evangelina Yanez Fuentes applied to work at Empire Nissan Inc. and signed various agreements to finalize her candidacy. She was later fired and sued the company for alleged discrimination and wrongful termination.
