Capital One Sued Over Request for Former Debtor’s Credit Report

Capital One Bank illegally obtained the credit report of a former credit-card holder without his consent after he had discharged his debt with the bank in bankruptcy, a federal lawsuit said.

Juan Moreno alleged that Capital One violated the Fair Credit Reporting Act by obtaining his credit report from TransUnion, Experian, and Equifax without a permissible purpose after his business relationship with the bank had come to an end.

Moreno had a credit card with Capital One until March 2022, when all of his debts, including his debt to Capital One, were discharged through an order of the Bankruptcy Court, ...
