Capital One Hit With Class Action Over Nine-Month Data Breach

Capital One Financial Corp. negligently failed to protect the personal information of thousands of consumers after a nine-month data breach exposed their data, a proposed federal class action said.

Lead plaintiff Andrew Willoughby alleged that Capital One breached its duties under common law, contract law, industry standards, and the Federal Trade Commission Act to implement reasonable and adequate data-security measures and provide timely notice of the breach.

The information exposed between August 2022 and May 2023 includes names, Social Security numbers, addresses, email addresses, dates of birth, telephone numbers, credit card numbers, transaction data, and other financial information, according ...
