Capital One Defeats Class Certification in Online Tracker Suit

Capital One Financial Corp. convinced a federal judge in California to deny class certification in an online tracker suit because individualized issues among the plaintiffs would overwhelm the benefit of proceeding collectively.

There aren’t enough questions common to the proposed class, and consent and standing issues would require individualized proof, Judge Trina L. Thompson of the US District Court for the Northern District of California found.

The plaintiffs challenged Capital One’s use of tracking technology from Meta, Google, and other third parties to collect employment, citizenship, and financial information that could be gleaned from a user’s online interactions. They sought ...
