A California school district escaped most Title IX claims brought by cisgender female athletes and an advocacy group over the participation of a transgender student on the girls’ cross-country team.
Even assuming the transgender athlete displaced the plaintiffs and other cisgender female athletes, the complaint’s allegations “do not support an inference of a finding of substantial proportionality” to support their Title IX effective accommodation claim, Judge Sunshine S. Sykes of the US District Court for the Central District of California said Wednesday.
