California Ruling Gives Ex-Lowe’s Worker New PAGA Shot on Appeal

A former Lowe’s Home Centers LLC worker’s Private Attorneys General Act claims on behalf of other aggrieved employees can go forward in federal court even though she must arbitrate her individual ones, the Ninth Circuit said Monday.

The unique state law, known as PAGA, allows workers to enforce California employment statutes on behalf of the government and other aggrieved employees. The worker still has standing to pursue non-individual PAGA claims in court, so the district judge shouldn’t have dismissed that portion of the suit against the home improvement chain, the US Court of Appeals for the Ninth Circuit said. ...
