California teachers and parents showed that a policy barring educators from informing parents about their students’ gender identities violates their constitutional rights, a federal district court said.
The policy deprives parents of the long recognized Fourteenth Amendment right to care, guide, and make health care decisions for their children, Judge Roger T. Benitez of the US District Court for the Southern District of California said in a Monday opinion partially granting the plaintiffs summary judgment.
