A former California superior court judge lost his bid to get retirement disability benefits amid his removal from office over disciplinary matters that stemmed partly from his deteriorating mental condition.
Former Judge Tony R. Mallery’s lawsuit is barred because there’s already been a final judgment on the merits of his claim by a competent court, Judge Edward M. Chen of the US District Court for the Northern District of California said Wednesday, granting the California Commission on Judicial Performance’s motion to dismiss.
