California High-Speed Rail Funding Suit Survives Hurdle

California’s lawsuit to preserve federal funding for its high-speed rail project can move forward after a judge denied a motion to dismiss brought by the Trump administration.

The state’s claim that the Department of Transportation unlawfully moved to yank more than $4 billion in funds for rail construction in the Central Valley is not a “disguised breach-of-contract claim” that would need to be heard in the Court of Federal Claims, Judge Dale Drozd wrote in an order filed in the US District Court for the Eastern District of California Wednesday.
