California Emissions Disclosure Law Survives First Legal Hurdle

The US Chamber of Commerce and other business groups failed on Tuesday to secure a quick end to their federal court challenge to California’s emissions reporting law.

The First Amendment lawsuit warrants a discovery process that delves into whether the law is “appropriately tailored” to regulate companies’ climate-related advertising, the US District Court for the Central District of California said.

“The Court needs a record on whether SBs 253 and 261 regulate a substantial number of companies that do not make potentially misleading environmental claims,” Judge Otis D. Wright II wrote, denying the business groups’ motion for summary judgment.
