The city of Ukiah, Calif., largely escaped a lawsuit brought by Vichy Springs Resort Inc. over a gun range operated by the city’s police department that sits adjacent to the hotel’s property.
But Ukiah didn’t move to dismiss the resort’s takings claim to the extent it relies on allegations of the continued presence of lead bullets on its property. Because that claim is under federal and state law, the US District Court for the Northern District of California will retain supplemental jurisdiction over those allegations, Judge Jacqueline Scott Corley said in a Monday order.
