Cadex Says American Rifle Store Infringes ‘Kraken’ Trademark (1)

Cadex Inc, which manufactures “Kraken” rifles, alleges an American firearms maker is infringing its trademark by selling goods under similar or identical marks.

In-Rut Rifles Inc allegedly advertised its business using “Kraken” at the Western Hunting & Conservation Expo in February 2024. Cadex alleges in the complaint, filed in the US District Court for the District of Utah, that In-Rut’s use of the word suggests an association with Cadex that doesn’t exist. After it sent a cease-and-desist letter in April, Cadex also alleges that In-Rut modified its website to use a “confusingly similar mark,” Crack’n.
