Burlington Stores Inc. assistant store managers gained approval for a $5.2 million settlement to address claims that the company failed to pay them overtime wages and misclassified them as exempt.
The 828 workers that are part of the collective action won a final order approving the settlement after the court found that on balance, the proposed settlement was “fair and reasonable,” said Magistrate Judge Ann Marie Donio of the US District Court for the District of New Jersey in a Monday opinion.
