Burlington Employees’ $11 Million Wage Suit Deal Needs More Work

Burlington Stores Inc. workers who say the company owes them overtime pay must fix up a proposed settlement worth a maximum of $11 million before a federal judge will allow the deal to move forward.

The assistant store managers asked for collective certification without providing any analysis as to whether they are similarly situated, and they also improperly seek to settle claims for workers who haven’t chosen to join the Fair Labor Standards Act suit, the US District Court for the District of New Jersey said.
