Burger King Beats Ex-Cashier’s Appeal in Sexual Harassment Suit

A former Burger King cashier can’t pursue a sexual harassment lawsuit against the company since her claims were adjudicated in a past suit, a federal appeals court ruled Tuesday.

Kenya Watkins’ Title VII claims against Burger King franchisee Genesh Inc. are barred on claim preclusion grounds, Judge Jerome A. Holmes said in an opinion. The US Court of Appeals for the Tenth Circuit affirmed the district court’s dismissal of Watkins’ suit.

Watkins, who is Black, alleged her manager groomed her for sex after hiring her as a cashier in 2014. Watkins was fired after contacting police about the harassment. ...
