Burger King Avoids Class Certification in Suit Over Whopper Size

A suit challenging the advertising Burger King Corp. uses to promote its Whoppers and other burgers isn’t suitable for class certification, a federal judge in Florida said.

The plaintiffs failed to establish the criteria needed to certify a nationwide class for any of their claims under Florida law, Judge Roy K. Altman said Tuesday for the US District Court for the Southern District of Florida.
