Building Contractor Loses Bid to Sink Telemarketing-Call Suit

Pro Star Builders Inc. must face a proposed class action alleging it made telemarketing calls to numbers on the national Do Not Call Registry, a federal court ruled.

Daniel Bird sufficiently alleged that he received two calls from Pro Star within a twelve-month period, which was enough to establish two of the three elements for a claim under the Telephone Consumer Protection Act, said Judge Josephine Staton of the US District Court for the Central District of California. Staton’s Nov. 28 order denied Pro Star’s motion to dismiss the case.
