Bristol-Myers Loses Venue Fight to Texas in Plavix Litigation

Bristol-Myers Squibb Co. and three subsidiaries of Sanofi must challenge Medicaid fraud claims from Texas Attorney General Ken Paxton (R) in his preferred county, not theirs, a Travis County judge ruled.

Judge Sherine Thomas said she’ll defer to Harrison County, where Paxton sued the companies last November for misrepresenting the dangers of the blood thinner Plavix. Thomas of the 353rd district court granted Paxton’s request to pause a counter lawsuit the companies filed in Travis County pending the outcome of the Harrison County matter.
