Bounty Hunter’s Suit Against Lawyer Was Timely, Court Says

The California Supreme Court ruled Thursday that a man suing an attorney over alleged malicious prosecution filed his lawsuit in a timely manner, reversing a lower court’s dismissal of the lawyer who had represented the plaintiffs in the underlying suit.

A two-year statute of limitations period applies to Daniel Escamilla’s malicious prosecution claim against attorney John Vannucci, rather than a one-year period, Justice Carol A. Corrigan wrote. California’s high court reversed a lower court’s decision to strike Vannucci from the suit and remanded to consider unaddressed arguments in Vannucci’s anti-SLAPP motion.
