BofA’s $8 Million Settlement With Check Fee Class Gets Early Nod

Bank of America NA will pay $8 million to settle class claims that it charged overdraft fees on checks that were re-presented for payment after having initially been returned for non-sufficient funds, under an agreement given preliminary approval by the Eastern District of Pennsylvania.

The proposed settlement doesn’t raise any doubts as to fairness, was the product of arms-length negotiation after “extensive litigation and discovery,” and no class members have objected, Judge R. Barclay Surrick of the US District Court for the Eastern District of Pennsylvania ruled Thursday.
