BofA Stuck With Suit Over Nevada Prepaid Benefits-Card Program

Bank of America NA must face most claims of a proposed class action alleging it engaged in abusive practices in managing a Nevada prepaid-card program that distributed unemployment benefits to Nevada residents during the Covid-19 pandemic.

The 123 named plaintiffs had standing to sue for most of their claims and adequately stated claims of violations of the Electronic Funds Transfer Act and the Nevada Deceptive Trade Practices Act in their third amended complaint, Judge Anne R. Traum of the US District Court for the District of Nevada said Wednesday.
