Boeing must again face claims from two flight attendants who suffered hearing damage from a malfunctioning smoke detector, a federal appeals court ruled Thursday, overruling a trial court that had dismissed the case.
Adopting the Texas Supreme Court’s interpretation of Texas’ statute of limitations, the US Court of Appeals for the Fifth Circuit said the window for the attendants to bring claims never closed.
In a two-page decision, the appeals court said a two-year deadline should’ve tolled to give the attendants time to resolve jurisdictional defects.
