Boeing Faces Skeptical Texas Justices in Southwest Pilots’ Suit

Boeing Co. should face lost wage claims from 8,000 Southwest Airlines pilots who couldn’t work during a mass shutdown of the 737 MAX airliner, some Texas Supreme Court justices indicated Wednesday.

The court did not seem convinced that the pilots’ third-party suit is barred under the federal Railway Labor Act because their union employment agreement is with Southwest, not Boeing.

“It’s a strange concept that federal law deprives them of any remedy,” Justice Jeff Boyd said during oral arguments in Austin.

“If a third party causes an injury to a worker why wouldn’t the third party be able to sue?” ...
