BA Sports Nutrition LLC shed claims that it duped consumers about the hydration qualities and sugar content of its BodyArmor sports drinks, but it must face proposed class claims that fruit images on the label were deceptive, a federal court in California said.
Alexander Hill and Marc Silver challenged representations that BodyArmor provides “superior hydration.” They also alleged they were misled into thinking that the drinks contained fruit juice and that they were healthy despite a high sugar content.
