A class of BMW vehicle owners and the automaker received preliminary approval for a $6 million settlement of a lawsuit over emissions-cheating devices in certain diesel vehicles.
Garner Rickman and others sued BMW of North America LLC for allegedly engaging in deceptive business practices by failing to disclose that under normal operating conditions, the BMW X5 and BMW 335d aren’t “clean diesels” and emit more pollutants than permitted under federal and state laws. Rickman alleged that BMW’s scheme was the latest in a worldwide diesel emissions cheating scandal that included “virtually all” diesel manufacturers falsely advertising their vehicles.
