BMW lost its bid to stop a lawsuit alleging that it’s strictly liable for a fatal airbag defect, with a ruling by the District of Arizona.
BMW of North America LLC argued it couldn’t be liable because the alleged defect didn’t develop until after the company sold the vehicle. The US District Court for the District of Arizona disagreed, denying the company’s motion for summary judgment, which allows the case to proceed to trial.
