Blue Diamond Growers is the latest beverage producer to defeat a suit challenging “vanilla” labeling, as a New York federal court said reasonable consumers wouldn’t think vanilla Almond Breeze is flavored exclusively with ingredients derived from the vanilla plant.

Reasonable consumers associate the representation of “vanilla,” with no additional language modifiers, to refer to a flavor and not to an ingredient such as vanilla beans or vanilla extract, the U.S. District Court for the Southern District of New York said.
