Blue Bell Creameries’ top-level holding company will have to face remaining investor claims a decade after a deadly listeria outbreak killed three of its ice cream consumers, a Delaware judge ruled Wednesday.
A $60 million settlement in 2020 in a related lawsuit had no effect on the derivative case brought by investor Jack L. Marchand II and now continued by his estate, Vice Chancellor Nathan A. Cook said. A trial is scheduled at the end of February.
