Lead plaintiff Amanda Daghaly failed to show that she suffered a concrete injury from Bloomingdale’s alleged practices that was sufficient to establish her standing to sue in federal court, a panel of the US Court of Appeals for the Ninth Circuit said Tuesday in an unsigned opinion.
The court vacated the judgment of the district court and remanded the case with instructions to grant the plaintiff leave to file an amended complaint.
