Iowa Gov. Kim Reynolds (R) asked the state’s supreme court to overrule a trial court decision that let stand a 2019 injunction blocking enforcement of a so-called “heartbeat” abortion ban.
The injunction was based on now-defunct US Supreme Court and Iowa Supreme Court precedent and can be dissolved based on the substantial change in the law, Reynolds argued in her opening brief Monday.
The case is part of a litigation trend that now has state courts deciding on the validity of abortion restrictions under state law following the US Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization. ...
