A federal appeals court Wednesday upended an injunction that shielded Arizona employees and companies doing business with the federal government from the Biden administration’s Covid-19 vaccine mandate for federal contractors.
An injunction issued by the US District Court for the District of Arizona in February 2022 isn’t warranted because the state failed to show a likelihood of success on the merits, the US Court of Appeals for the Ninth Circuit ruled in an opinion by Judge Mark J. Bennett.
President Biden had the authority under the Procurement Act to issue the contractor mandate, Bennett said.
