Black Workers Lose Class Bias Suit Over Hair Testing for Drugs

Two Black workers lost the remainder of their race bias claims against drug testing company DISA Global Solutions and other companies stemming from their suspensions for allegedly false positive hair-test results.

The ruling by the US District Court for the Eastern District of California dismissed, for now, the remaining discrimination claims in a proposed class lawsuit against DISA, Valero Refining Company-California, Timec Services Co., and parent Ferrovial Services Infrastructure Inc.

The case involves a somewhat recurring issue in employment law: the reliability of hair-follicle testing for drugs and whether they can result in race bias.
