Black UPS Delivery Driver to Get Hostile Work Environment Trial

A Black UPS delivery driver may be able to prove a White manager made his work environment racially hostile through a pattern of scrutiny and discipline that White drivers didn’t face, the Southern District of New York ruled.

A trial could show United Parcel Service Inc. is liable to Barry Wilkins for racial harassment under Title VII of the 1964 Civil Rights Act even though there’s no evidence Chris Valent, the former business manager at Wilkins’ New Windsor, N.Y., facility, made “any facially racist” remarks or other direct proof of racism, the court said.
