Black Tesla Workers Can Pursue Injunction, Some Claims in Court

Two Black Tesla Inc. employees who are part of a group leading a proposed class race discrimination lawsuit can pursue some of their claims in court, as well as their request for a public injunction against the automaker under California’s Fair Employment and Housing Act.

The arbitration agreements Monica Chatman and Evie Hall signed when they became direct employees of Tesla, and which obligate them to arbitrate claims arising out of their employment, don’t extend to claims of prior workplace race bias they experienced while working for the company through a staffing agency, the California Court of Appeal said Wednesday. ...
