Black Healthcare Worker’s Bias Lawsuit Gets Partially Revived

Two HCA Healthcare Inc. subsidiaries must face a revived hostile work environment claim by a Black nurse assistant who says he was subjected to job harassment when his assignments changed based on the racial preferences of patients.

A lower court wrongly disregard the testimony of Lawrence Dike, the former Bay Area Healthcare Group Ltd. and Columbia Hospital Corp. of Bay Area employee, as “self-serving,” a three-judge appeals court panel said.

The lower court also failed to assess the “cumulative effect” of the hostilities he faced, instead evaluating each event individually, the US Court of Appeals for the Fifth Circuit said. ...
