A man who says disability bias caused Black Diamond Capital Management LLC to pull his accepted job offer after he disclosed his past arrest and previous opiate addiction can’t continue in the case anonymously.
The ruling is a reminder that the presumption of public access to judicial proceedings and information is “strong” and that the default rule is that parties must sue under their true names. Employment discrimination and other plaintiffs typically face a heavy burden to show they should be allowed to pursue claims under a pseudonym.
