Black Comics See Partial Appeal Win Over Airport Police Stop

Two Black comedians convinced the Eleventh Circuit to revive their Fourth Amendment challenge after they were stopped by police and questioned about illegal drugs while boarding planes at Atlanta’s Hartsfield-Jackson International Airport.

The plaintiffs plausibly alleged unreasonable seizures, pursuant to an unconstitutional county policy, Judge Elizabeth L. Branch said for the US Court of Appeals for the Eleventh Circuit. Branch reversed the dismissal of the comedians’ Fourth Amendment claims and affirmed the remainder of the lower court’s ruling.
