Biomet Inc. lost its bid to undo a $3.55 million verdict to an Iowa woman who alleged she suffered injury from her Biomet M2a-Magnum hip prosthesis, and that the company knew of problems with the device but put revenues first, a federal court in the state held.
Lori Nicholson’s evidence supports the jury finding that the device was defectively designed and a reasonable safer alternative was available when she had her left hip replaced in 2007, the U.S. District Court for the Northern District of Iowa said Thursday.
